Know Your Rights: A Guide for Immigrants & Undocumented Individuals
No matter your immigration status, you have rights under U.S. law. Being informed can help protect you and your family in difficult situations.
Your Basic Rights
You Have the Right to Remain Silent
You do not have to answer questions about your immigration status, where you were born, or how you entered the U.S.
If you are stopped, you can calmly say: “I am exercising my right to remain silent.”
You Have the Right to Refuse Entry
Immigration officers cannot enter your home without a warrant signed by a judge.
Ask them to show the warrant through a window or slip it under the door. Check that it includes your name and address.
You Have the Right to an Attorney
Do not sign any documents without speaking to a lawyer. Some documents, such as voluntary departure orders, may waive your rights.
If you are detained, you have the right to call an attorney or a trusted contact.
What to Do If You Are Stopped by Immigration or Police
Stay Calm. Do not run, argue, or lie.
Do Not Resist. Politely state your rights.
Carry a Rights Card. Hand it to the officer:
“I exercise my right to remain silent and wish to speak to an attorney. I do not consent to a search.”
What to Do If ICE Comes to Your Home
Do Not Open the Door. Ask officers to show a signed warrant through a window or under the door.
Stay Silent. You do not have to answer questions or let them in.
Record Details. If safe, take note of officers’ names, badge numbers, and vehicles.
Document the Event. Take photos or videos if possible, but do not interfere with their actions.
Protect Yourself and Your Family
Make a Family Safety Plan:
Designate someone you trust to care for your children if you are detained.
Memorize important phone numbers in case your phone is confiscated.
Keep important documents, such as passports and birth certificates, in a safe and accessible place.
Know Your Case Status:
Stay informed about your immigration case. Update your address with immigration authorities and the court to ensure you receive all notices.
Attend All Court Hearings:
Missing a hearing can lead to a deportation order. Always appear on time.
